Terms and Conditions

Star Auto Shipping maintains transparency through these governing terms. By using our services, you acknowledge agreement to these conditions. Contact our support team with any questions.

1. Carrier Assignment & Vehicle Release

Star Auto Shipping acts as a property broker arranging transportation. Customers accept the assigned carrier's bill of lading terms upon vehicle pickup. The pickup contact bears sole responsibility for verifying the carrier's dispatch sheet before release. Star Auto Shipping assumes no liability if vehicles are released to unauthorized carriers.

2. Unilateral Modifications Prohibited

Customers cannot alter agreement terms without written consent from Star Auto Shipping LLC, which explicitly rejects any unapproved additional terms or conditions.

3. Transportation Coordination

Star Auto Shipping arranges transportation around requested dates with an assigned carrier. Neither the company nor carrier bears responsibility for delays, car rental fees, or accommodation costs.

4. Shipment Delays & Force Majeure

Star Auto Shipping LLC agrees to arrange the transportation of the described vehicle(s), while acknowledging weather, mechanical issues, and market conditions may cause delays. If a carrier cancels, Star Auto Shipping has three business days to arrange replacement service. The company explicitly does not reimburse tolls or rental expenses.

5. Carrier Responsibility & Bill of Lading

Customer-carrier relationships are governed by the carrier's straight bill of lading terms, available at carrier offices.

6. Pickup/Delivery & Rescheduling Fees

Carrier responsibility begins at origin pickup and ends at destination delivery. Customers must notify Star Auto Shipping if unavailable. A $150 rescheduling fee applies if pickup cannot proceed. Postponement requests require 10 business days notice. Delays exceeding 14 days may alter pricing.

7. Carrier Access & Towing

If carriers cannot access pickup or delivery locations, customers must meet trucks at reasonable alternative sites. For inoperable vehicles or inaccessible locations, customers pay for local tow truck transport to the carrier.

8. Payment Methods & Delivery

Delivery requires cash, money order, or cashier's check in US funds. After 3-24 hour notification, vehicles may be stored at the carrier's nearest terminal if customers lack proper payment. Credit card payments incur a 5% service charge. Carriers may accept Zelle at their discretion.

9. Personal Items in Vehicles

Customers may include personal items up to 100 pounds, placed in the trunk or below the window line for safety compliance.

10. Inoperable Vehicles

Customers must fully disclose inoperable vehicle conditions. A $200 fee applies if vehicles become inoperable during transport. Inoperable vehicles must roll, steer, and brake. Inaccessible inoperable vehicles require customer-paid tow service to the carrier.

11. Excluded Liability

Star Auto Shipping LLC, along with its agents, officers, directors, and carriers arranged by Star Auto Shipping, will not be held responsible for damages resulting from theft, vandalism, strikes, riots, acts of terrorism, political unrest, or acts of God. Customers should maintain personal insurance covering vehicles during shipment.

12. Vehicle Preparation Responsibility

Customers must prepare vehicles by removing or securing loose parts, fragile accessories, low-hanging spoilers, fog lights, and antennas. Detached parts and resulting damage become the customer's responsibility.

13. Damage Documentation

All transport fees must be paid before initiating damage claims. Damage requires documentation on the bill of lading, signed by the driver and customer/consignee. Signing without noted damage confirms good-condition receipt, releasing both Star Auto Shipping and the carrier from liability.

14. Damage Notification & Claims Process

Customers must notify Star Auto Shipping and the carrier within 24 hours of discovering damage. Written descriptions, photos, and two repair estimates must arrive within 10 days. Claims fall under the Carmack Amendment to the ICC Termination Act of 1995. Customers should seek independent legal counsel regarding these federal laws.

15. Payment Options

Star Auto Shipping offers two payment formats:

Option 1: Single upfront payment covering both service and carrier fees, with a potential 5% credit card fee.

Option 2:Two installments - the first due upon electronic signature/carrier assignment, the second due upon delivery. Payment schedule adjustments may incur additional charges applied to the customer's credit card.

16. Carrier Assignment Timeline

Star Auto Shipping has five business days from the first available release date to locate and assign a carrier.

17. Refund/Cancellation Policy

If Star Auto Shipping cannot confirm a carrier within five business days from the first available pickup date, customers may keep the order open or cancel for a full deposit refund. Orders canceled before pickup or before day five forfeit the deposit non-refundably. Services are considered rendered upon carrier assignment. Cancellations must be submitted via email to contactus@starautoshipping.com; phone cancellations are not honored. Post-dispatch cancellations result in deposit retention but full refund of the remaining balance.

18. Governing Law & Jurisdiction

These terms are governed by Texas state law without conflict-of-law principles. Customers irrevocably consent to United States District Court and State courts in Harris County, Texas for all legal actions, with judgment enforcement possible in any jurisdiction.

19. Liability Limitations

Star Auto Shipping LLC's liability is limited to the amount of the deposit indicated on the customer's quotation. The company cannot be held liable for designated carrier damages. Total cumulative liability shall not exceed total fees paid. The company assumes no liability for direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages, including business losses or litigation costs, regardless of prior notification of damage possibility.

20. Multiple Transport Bookings

Booking a vehicle simultaneously with multiple companies undermines service quality, as carriers typically select higher-priced options. If Star Auto Shipping cannot secure a carrier due to multiple bookings, the deposit is forfeited and the order automatically canceled.

21. Licensed Property Broker Status

Star Auto Shipping is a licensed and bonded property broker. Motor carriers manage their own damage claims. Claim processing may require several weeks while drivers return to terminals with original bills of lading and condition reports.

22. Port Facility Charges & Island Shipments

Star Auto Shipping bears no demurrage liability. Hawaii, Alaska, U.S. Virgin Islands, and Puerto Rico shipments require sea-portion payment before port arrival. Booking numbers and payment instructions follow order receipt. Non-compliance risks delays and storage fees. Hawaii vehicles must be fully operational with working emergency brakes; port agent refusal makes shippers liable for all storage and redelivery fees.

23. Order Acceptance

Submitting an order online, via fax, or via email constitutes acceptance of these terms and conditions as available on the Star Auto Shipping website.

24. Vehicle Availability During Transport

Customers must ensure vehicle availability throughout the transport period. If a vehicle becomes unavailable after order placement and carrier assignment, Star Auto Shipping reserves the right to cancel without refund.

25. Excluded Damages

Neither Star Auto Shipping LLC nor the carrier will be held responsible for the following:

  • Damage unidentified at pickup due to poor weather or lighting
  • Mechanical component damage (transmission, engine, exhaust, undercarriage, suspension, bearings, alignment, brakes, charging systems, batteries)
  • Non-factory audio/video equipment or non-retracting antennas
  • Roadway or sky-falling object damage
  • Personal item damage or fines
  • Convertible/decorative top damage exceeding two years old
  • T-top or canvas covering damage
  • Factory tie-down failure damage
  • Interior upholstery damage
  • Fluid leakage damage
  • Cooling system or battery freezing damage
  • Inoperable vehicle damage

26. Price Contingencies & Vehicle Disclosure

Quoted prices depend on complete vehicle type disclosure. Undisclosed modifications or dimensions - including cab type, bed length, diesel engines, 4X4 specifications, lift kits, oversized tires, roof racks, and toolboxes - may incur additional fees. If a carrier cannot load a vehicle due to non-disclosure, Star Auto Shipping cancels the order without refund.

27. Order Rejection Rights

Star Auto Shipping reserves the right to reject or cancel any order for any reason at any time.

28. Indemnification

Customers agree to indemnify, defend, and hold harmless Star Auto Shipping, its employees, officers, and directors from all losses, liabilities, damages, settlements, judgments, penalties, and expenses (including attorney fees), and suits arising from customer acts or omissions, including injury, death, or property damage.
